Have you suffered an injury abroad which was not your fault but are not sure how or where you can make a claim? Read on! Personal Injury claims in the UK have experienced rapid growth in recent years, but what if the accident happened abroad? How does the procedure work? There are generally three categories to consider. Two of which you can file a claim in the UK, the other of which you are subject to the jurisdiction and legal procedure of the Country where you suffered the injury. These are examined further below.
(a) Package holiday accidents
If your accident occurred as part of a package holiday purchased from a UK company then you may be able to file a claim against that company, and most importantly be able to do so in the UK. This could be, for example a matter relating to the hotel, the transfer from the airport or a package tour booked through the operator. There are personal injury solicitors whom specialise specifically in the category and it would be strongly advisable to seek their assistance if pursuing this option.

(b) Accidents abroad caused by UK nationals
Where the incident was caused by a UK national whose permanent residency is also in the UK then once again it will be possible to file a claim through our domestic legal system. Contact a personal injury solicitor to obtain expert advice on the viability of any such claim. After all it is not enough that you suffered injury - you must legally prove it was the respondent's fault to make a successful claim.

(c) Other accidents abroad
These are accidents occurring abroad which cannot be connected with the UK. If no link can be shown then the domestic courts will have no jurisdiction to hear a claim and consequentially any potential claim made will be governed by the foreign law applicable in the country which the incident occurred. If you wish to pursue the claim you will have to find a solicitor in that country and seek advice from them. You can search the British Embassy website to locate English speaking solicitors.

When claiming for personal injury, it is important to consider whether it really is worth making a no win no fee uk claim. Assessing factors such as how serious the injury is, what the chances of success are and what the likely compensation would be are all questions which may help determine whether pursuing a claim is worthwhile.
